Affiliation orders

Hello,

I am just wondering about an affiliation order for an illegitimate child.
 
The father had been summoned back to court for non-payment, the child was living in a childrens home. The child was born in the late 1920s and the newspaper clipping i found was from several years later.

The child was told that the Mother had died during childbirth.

My question is, if she had died during childbirth, can the childrens home apply for an affiliation order or would they have an order with a different name?

I don’t know the answer but as background you can check to see if the mother really did die when the child was born or not.

Have you found a death certificate for the mother?

I am curious how they knew who the father was if the mother had died during childbirth, no DNA then.

Yes I wondered that too. 

If a payment arrangement was already in place and he stopped paying then who set it up in the first place?

I haven't been able to find a death certificate or anything else about the mother.

Generally the poor law union would be looking to families to provide financial support before accepting someone into the workhouse/ childrens home system. I have relatives in the 19th century who were prosecuted for not supporting their mother.

Died in childbirth probably means from the effects of the birth process, so that could be some hours or days later. If the mother was already in the workhouse/poor system she probably was required to make a statement as to the parentage, or if the child was taken into care afterwards, her family and friends would provide evidence as to the likely suspect and the couple's relationship. You can find many newspaper reports of such cases where various people will tell how X and Y would do the deed in back lanes or stay overnight in the same room to support the affiliation claim

With regards to financial support from the families, from what i know (and have read about in a newspaper!) i believe that it would have been common knowledge about who the father was so it would have been easy enough to gather the evidence.
I'll keep on looking for details about her, she's in there somewhere.
