Land Disputes

Hi Everyone I am trying to find out the result/outcome of a land dispute made by my ancestor William BYRNE in 1834 case 924 against John HOSKINGS and John Terry HUGHES.

  I have attached the  relevant link/ advertisement from the Sydney Gazette and NSW Advertiser TUE 23 MARCH 1841 P 4.  and 15th December 1834.  Hoping to clear this up.

Try looking fot the Macquarie Uni Law School's website that has the Case ahistories for at least the 1830s,  by year ...  ;D

Hoskings & Hughes were prominent and were prone to threaten to sue ....   they were related to various "significant" Colonial families.   

If you cannot find the Case Files, let me know by PM.  I last used the online link several years ago,  and is NO LONGER  on my favourites list ... not sure why.

Hi JM I have just emailed the Macquarie Uni re the land dispute.  Even if the person to whom I sent the email cannot help they maybe able to advise or direct me.  Just need to find the outcome.  I'm sure it is at the NSW State archives but again will need them to look if Macquarie cannot help.

I thought that the results of the Court of Claims was advertised in the Gazette/s??  Maybe I'm wrong.  All good.  Many thanks Dianna

 :) keep up the effort.  The year 1834 is the focus of various studies on NSW Supreme Court cases by various Academics over many years . Absorb the context,   cast eyes over the local politics, .... there were  still huge issues for came free landed gentry to accept that offspring of emancipated convicts with merchant enterprise backgrounds and land were anticipating being equals.   

About this time, in England, tthe super-rich (2nd generation Industrial revolution money, ) became interested in  developing AUst as NEVER a convict in their colony .... so Rich English pollies like Molesworth set about establishing two colonies,  Sth Aust and New Zealand.  Then the King died and young  Queen Victoria reigned.

The rules changed, and two classes of people were encouraged to migrate:  a) labourers  to work for the b) landed owners.   

This contributed to boom and bust ecomics until 1851 GOLFEVER.  n.b. convictism to mainland Aust1 effectively ceased 1840 (TAS 1853ish).   So unemployment, no social welfare, and issues with in balance of eligible female to males.

Hi JM Well I finally found the "exact" link.

Took a while and in there was a very interesting case in which a murder/bashing took place two doors away from my Michael BYRNES house of William Holness  So good to find this.  The man who was killed was in Michaels house (buying beer and to show him something) just before he was killed.  Wow it's like gold finding these things. 

It seems it was considered "important" because it involved two soldiers from the 73rd Regiment

Many pages also on Historical Records of Australia which I have just read through.  Just really add's something to Michaels life in Early Sydney.

Now I'm finding information on the BIGGE Report re evidence to given both Orally and Written to Thomas Bigge whilst he was in NSW 1819-21.  Michael is mentioned there too as one of the main Brewers of the time giving his opinions and thoughts on what was the best grain etc to use for the brewing/distilling.  So much fun.

I may be able to find out more about the case/land dispute at the State Archives.

There is another record which relay's to my Michael which I would have missed if I hadn't read the Minerva book by Barbara Hall.  There was a mention of Michael in 1810 in COD 297B, this is not digitised apparently so I will have someone go to the archives and copy it. 

Bench of Magistrates proceedings 1801-1814, I have the exact date so hopefully it is in chronological order. Thanks for the encouragement.  Regards Dianna
