I understand the wait is currently 1+ year. If you apply without the next-of-kin's permission the MOD will redact the soldier's next-of-kin details contained in his military file.
Also, I've heard the MOD will not release any documents containing medical or disciplinary action (although dental records sometimes appear). This relates to WW2 records.
