Good day everyone, I am in desperate need of additional brainpower with this one.

I have the will for my great great great uncle, Thomas Bennie, dated 8 June 1840. In it he states that he is married to "Mary Bennie or Horne", he lists three children who will benefit from his estate, a son John and two daughters Catherine and Mary, he also notes that he had a previous wife as her chest of drawers are granted to Catherine. He also leaves part of his estate to his mother, "Margaret Bennie or Scott".

Now I have been trying to locate more on these individuals.

I have Thomas' baptism, he was the son of James Bennie and Margaret Scott, and was baptised on 1 July 1798 in Glasgow.

I have also found Thomas in the 1841 census in Taylor Street in Lanark, he is listed as being 40 years old and is listed with Mary (40) and John (13). Thomas and John are listed as being born in county. His daughters though do not appear to be listed with him.

I have though found another 1841 census of interest, and that is of a Margaret Binnie aged 65, also living in Taylor Street in Lanark. She is listed with Catherine Binnie (19) and Duncan Scott (43). I thus believe these are the right families with Catherine being Thomas' daughter(?) and Duncan being Margaret's nephew(?). Catherine and Duncan are listed as being born in county.

I have not found Thomas' daughter Margaret though. I have also not been able to find baptisms for any of his children and have not found a death for his mother.

Thomas married Mary on 27 Nov 1838 in Glasgow so does not appear to be the parents of any of his children. I have not found his first marriage or the name of his first wife (as I have not found his children's baptisms).

I have also not found a baptism for Duncan to establish his relationship to Margaret.

Any help in locating more information on these individuals would be greatly appreciated.

Hi Duncan

Have you tried following up on Thomas's children to their marriages and deaths to see what the name of their mother was? In the absence of any records in the Old Parish Register, this may be the only way to check on her name.

I'm a bit confused here is what Scotland's People has, there is a 13 year difference in his Will.

James/Horn had 7 children from 1838-1851.  This James was a Collier and they were married 05 Jun 1833 in Barony.

Are you absolutely proof positive this James is the same as the one who married Scott?

Hi Monica, I am currently trying to trace the children, but am not at this point having much luck.

Hi DonM, the will was drawn up in 1840 (that is when it was signed when you go into to read the actual image of those files, it was filed in 1853 (I take it he died in or shortly before 1853, I have not yet found a burial though to confirm this date)

James/Horn had 7 children from 1838-1851.  This James was a Collier and they were married 05 Jun 1833 in Barony.

It was Thomas, son of James and Margaret who married Mary Horn on 27 Nov 1838. That James that you seem to be referring to, who married on 5 Jun 1833 is a unrelated individual who I have not come across. This is most certainly not the James who was the husband of Margaret Scott as as far as I can work out he was deceased by the time the will was drawn up in 1840.

There is this possible marriage entry to consider for Thomas's first marriage:

Thomas Bennie and Elizabeth Urquhart
Marriage Date: 20 May 1821
Marriage Place: Glasgow,Lanark,Scotland

You mentioned Margaret and Mary (apart from Catherine) for Thomas' daughters. He only had two from what you said. Mary or Margaret?

There is an online tree on ancestry which shows a Catherine Scott Binnie, daughter of Thomas Binnie and Elizabeth Urquhart.

This shows her born c. 1823 in Glasgow. Her marriage is showing on 14 April 1845. Groom a Thomas Owen. 10 children born to them between 1846-66 in Glasgow.

This Catherine's death is given as being on 26 April 1882 in Glasgow. No original sources included on the tree.

You might want to consider viewing the death cert to confirm these details.
