FindMyPast are saying on their FB page:

"I see that our Head of Customer Services has confirmed to you that Findmypast did not quote that an annual subscription could be purchased for £10. This information was incorrectly quoted on other websites which are not related to Findmypast. Our sincere apologies once again for the disappointment caused by this."

However, when the advertised code was submitted on FindMyPast's site  it changed the subscription price.

I can't find anything showing the exact rules online

The general principles of the common law of contract (a vast and complex subject as you will know) apply.  A contract may be vitiated by (among other things) mistake, and whether it is or not will depend on all the facts of the particular case.

As I said in this old thread (post 32) subscriptions to FindMyPast are not covered by sale of goods legislation: www.rootschat.com/forum/index.php?topic=682699.msg5271488#msg5271488.  The Consumer Rights Bill which seeks to plug relevant gaps in statutory protection for consumers of digital content is still making its way through the Parliamentary process, having received its 3rd reading in the House of Lords this week.

As a Rootschatter and FindMyPast subscriber I empathise with those who are disappointed and feel let down by what has happened and the handling of the issue after the event.  As a litigator I'd recommend very careful thought before anyone embarks on the costly, stressful and uncertain adventure of litigation over this.

Thanks avm228.  I agree there would be little comeback for anyone trying to litigate against the company, not least because the "damage" is low, namely the loss of a £90 discount.

I know that subscriptions aren't covered by the sale of goods Act, but they are covered by other legislation which does I believe include provisions for mispricing, but am happy to stand corrected. As your quote from my post was about, I just can't find the specifics online and its too long ago that I studied contract law to remember them. ;)

Edit - I've just emailed Nicky Doran suggesting that if they had actually been more specific in their emails about what legislation they were relying on to revoke the subscriptions, it would have been far more helpful.

that would certainly satisfy me.  The email I received was kind of 'we can and we have' obviously not those words but that was the tone.

Its their total ineptitude that gets me, in most of the things they publish, even down to errors in history. Does ANYONE check stuff before it goes out? 

Problem is they still have the best records out there so I'm stuck with them if I want to continue my family history.  :D
