Just received this:
I write in connection with a Findmypast subscription purchase that you made earlier this week.
The terms and conditions of this particular promotion stated that it was intended to give you a 90% reduction on a 1 month subscription so, 1 month for £1.
For a short period, it was possible to use the discount code for a purchase of an annual subscription and I can see that you have managed to purchase a £99.50 subscription at the price of £10.
That was our mistake and I have now corrected that by refunding your £10 payment and cancelling that annual subscription. That credit refund should reach your card within the next 2 or 3 working days.
We are sorry for any disappointment caused by this error and we have taken steps to ensure that an error of this kind does not occur on future discounted promotions.
With kind regards
Nicky Doran

My reply:
Not acceptable.
The offer was advertised by FindMyPast  & paid for by subscribers which constitutes a contract.
As with any sale of goods or services that which is advertised must be honoured.
I do not want nor do I accept a refund & I expect FindMyPast to honour that which was advertised.
Do not remove my annual subscription as this will constitute a breach of the code of practice.

there were no T&Cs attached to the offer other than it couldn't be used in conjunction with any other offer.

I haven't been given a months complimentary.

I expect you will find, Jim that your subscription has already been removed, I checked mine and it is back to October 2015.

As I understand it, it is not the advertising that must be honoured, as that is only an invitation to buy and they don't have to accept your offer. What could be a contract though is the fact that they took the money and sent out receipts in the form of emails. However, as I said earlier, I presume that they have  sought advice from their legal department before acting.

That's my point, they accepted the money.
If you buy an item for £10 in a sale, the store can't snatch it back because it should have been £100 & just throw your tenner back at you.

The least they could do was to give everyone a complimentary month for their error

Perhaps I got a free month because I didn't have a current sub. and they were trying to hook me back? ;)

Jennifer

Probably, I already have a sub, but out of goodwill they could have given an extra month. I wonder if I can ask for the interest on the £10 for the 4 days it will have been out of my bank account?
