That Anne is 25yrs on indents ship Edward of London meaning from London.married at Bathurst.

Re the application to marry  FITZPATRICK-WALKER

The commercial website ANCESTRY has the image uploaded.   

I read that that Anne was assigned to Mr Johnston.

I further read that Anne was aged 28 (originally written as 25), a spinster, ex the Edward of London, 7 years, bond, assigned to Mr Johnston, who gave leave for the couple to marry “leave of master given”

There’s an asterisk and it leads to the following written words “Married, husband Thomas Daly here per  5 Mangles”

Likely she is the lass who married James Fitzpatrick in Bathurst in late 1829.

They do not allow you to marry unless husband is dead we know he was still alive 1853
she would have been knocked back.Cannot find record where it says married to Thomas daley on permission record

That's not actually correct.   There's quite a number of marriages in NSW where one or both had been previously married, and the first spouse was alive and well and also living in NSW.    Perhaps you may care to read the following research paper....  Perhaps Anne Walker was of the understanding that by being transported, her earlier marriage was ended.  http://www.aifs.org.au/institute/seminars/finlay.html   

Re the record where it says married to Thomas Daly,  the asterisk is against Anne Walker's name, and the words it points to are at the bottom of the page.

According to NSW SRO's index, the ToL 31/757, was issued at Patricks Plains .... which I think you will find is basically Singleton rather than Maitland.

EDIT TO NOTE My mistake, it was issued at Paterson's Plains.
