I have received this information from the family who are searching:
His wife Margaret (in Scotland) made a successful claim on his estate (as he didn't leave a Will) in December 1881 and mention is made of him owning a home in these records, although the only address details it gives is that it was located in Victoria. A newspaper advertises that his possessions were sold by auction on 27 September 1881.

The following is info about the progress of the settlement of his estate from the Victorian Government Gazette records below. From what we can see, he lived in Epsom, Sandhurst and therefore was probably involved with the Bendigo Pottery as his occupation in Scotland (where he was born and married) was that of a Journeyman Potter.

Jessies Mum....I gave you two of those Victorian gazette notices with references for you to look them up.  Yes he died intestate and his possessions along with the assets of 28 other peoples estates, were advertised for auction.  The assets of the estates did not mention real estate.  If I recall his estate was valued at around $45.   I did look up the Gazettes previously and really nothing other than the estimated value in the first reference and the residual in the last reference all in table form with other peoples' estates.

I assume the information that John died in Bendigo Hospital came from those you are helping?

That's right Cando - thanks.  Was just posting all of the information I had received from England for the person I am researching and did not want to miss anything out - sorry if I doubled up, but would prefer to than not.
Yes, have emailed the second Bendigo group as the first group only accepts snail mail.  So am waiting to hear.
Have also contacted the family again I am searching for to seek where they had this information confirmed.

Not so much doubling up...I wondered if you had looked at the gazette.

Late of Epsom, Bendigo doesn't necessarily mean he died at Bendigo.  I understand it to mean that Epsom was his last place of residence.  Perhaps I am wrong about this.

It would appear that his youngest child, Louisa Florence Livingstone MAYER was born in 1879.

Do you know the story behind John emigrating to Victoria, possibly gaining employment and purchasing a home?  Was his wife and family intending to join him?

Have you read his Probate files at PROV?

There is no mention of him owing a home or any real estate, nor of them selling any of his possessions. Only that he had money in a savings account.

It also states that Henry S Palmer, Superintendent of Police at Sandhurst informed the Curator of Estates & believed that John Mayer late of Epson, Sandhurst died 3 Jan 1881 at Bendigo District Hospital.

There is no mention of him owing a home or any real estate, nor of them selling any of his possessions. Only that he had money in a savings account.

It is also clear in these documents that there was no need for Margaret to "make a claim" because she was known from the outset to be his rightful inheritor, along with his eight children whose names are listed.

One wonders, in the absence of a will, how the details of his children's names were known. It is mentioned that their exact ages are not ascertained.

My suspicion is there was a relative with him in the district who knew his family details.  :)

This child is not mentioned in the file.

Plus a few pence and all cash in the bank so no house and he was a labourer.

Family stories certainly become skewed over the years :)
