I am having difficulty deciphering the will of my 5x great grandfather, Jacob Easterbrook.
Is there anyone who may be able to help?

OK, here's the beginning.  I'm out of time for the moment, so if somebody else wants to pick it up, please do.... or I'll work at it again later this evening.

In the name of God Amen
I Jacob Easterbrook of the city of Bristol Gentleman being in a
bad state of health but of sound mind memory and understanding
thanks be given to God for the same do this twenty eighth day
of March in the year of our Lord one thousand seven hundred
and eighty four make ordain publish and declare this to be
my last will and testament in manor and form following
that is to say I give and bequeath unto my Dear Uncle the
Revd Joseph Easterbrook Clerk the sum of fifty pounds of
lawful Money of Great Britain to be paid to him within
six months next after my decease I give devise and bequeath
unto my Dear Uncle Simon Wayte  of the city of Bristol
Hooper all these my freehold ??  ??  ?? or dwelling houses
together with the ?? and appurtinances thereto
belonging ??  ?? standing and being in the oldmarket in the
said city of Bristol ?? in the tenure or possession of my
Sister in Law Ann Easterbrook and ?? all other freehold 
premises whereof I may be entitled to at the time of my Decease
??  ?? my said Uncle Simon Wayte his heirs
and assigns for ever and as to all the rest residue and remainder
of my Houses and ?? for Money Goods Chattles Stock and
utensils in my late Business of a Tobacconist Debts and other

Many words I couldn't make out, but this is a start.

Easterbrook clerk the sum of fifty pounds of lawful  money of Great Britain to
be paid to him within six months next after my decease and give devise and
bequeath unto my dear uncle Simon Wayte of the city of Bristol a Hooper all
these my freehold messuages  (containments? )  or  dwelling houses together
with the warehouses and appurtinances thereto belonging with all housing 
standing and being  in the Oldmarket in the said city of Bristol were  in the t
enure or possession of my  Mother in Law Ann Easterbrook and (...) all other
freehold  premises  whereof  I  may be entitled to at the time of my decease 
to hold that same and very part and parcel thereof with that appurtinances 
(unto?) my said (....) Simon Wayte his sons and assigns for ever and as to all
the rest residue and remainder of my houses and servilities(?) for money
goods chattels stock and utensils in my late business of a Tobacconist Debts
and other personal estate and effects of what nature or kind the same or and
whatsoever the same and lying and  going (after payment of all my just debts
funeral expenses and the charges of proving this will I give and bequeath the
same unto my said  uncle Simon Wayte to hold the same unto the said Simon
Wayte his executors administrators and assigns to and for his and their own
proper use and benefit and as his and their own proper goods chattels and
effects for ever and I so hereby make nominate (....??) and appoint my said
uncle Simon Wayte  whole and sole executor of this my last will and testament
and lastly I do hereby revoke and make void all former and other will by me at
any time heretofore made and do declare this to be my last will and testament
in (........??.) whereof I have hereinto set  my hand and seal  this day and year
first before committee Jacob Easterbrook   (?? ) signed sealed published and
declared by this said testator Jacob Easterbrook as and for his last will and
testament in the presence of us who in his presence and at his request and in
the presence of (varied?) others have subscribed our names as witnesses
thereto William Taylor James Vayle E Marchant

This will was proved at London on the fifth day of December in the year of our
Lord one thousand seven hundred and eighty five before the worshipful William
(Marham?) Doctor of Laws  surrogate of the Right Worshipful Peter Calvert also
Doctor of Laws Master Keeper or Commissary of the (prerogation) court of Canterbury
lawfully constituted by the oath of Simon Wayte the sole executor named in the said
will to whom administration was granted of all and singular the goods chattels and
credits  of the Deceased having been first (sworn?) only to administer a Definitive
(.....??) leaving both pronounced and promulged for the (part?) and validity of the
will as (...) this (..) of court appear.

Silvervista, you will see I thought the female beneficiary to be mother in law, going by
the way the M's are formed (such as in March), but I will agree that a mother-in-law
seems unlikely - no wife or heirs mentioned, and mo in law would not be called
Easterbrook most likely.

I managed to fill a few of your gaps, perhaps you can complete mine :)

Well I got the cabbage, spinach and onions planted, decided to slip back inside for a peek.  Good work you two!  You're right -- it does say Mother-in-law.  Don't know if it was my eyes, or my mind going off on that one --- so MIL has the same surname!

It's possible that the mother in law is really his step mother which would account for her having the same surname.  I have a similar will from the 1600s where a spinster refers to her father in law and mother in law in her will.  Her mother remarried and after her mother's death her step father remarried himself and these are the people she is referring to.

Hi Ermy

I was wondering the same myself. I was having difficulty in matching the name Ann to what I already know about his wife/parents. The only problem I have is that I am having difficulty tracing a second marriage of his father to a lady called Ann!
Would it seem possible that the 2 gentleman mentioned as uncles may be stepbrothers?
