death records help please!
« on: Wednesday 08 December 10 14:47 GMT (UK) »
im sure this has been asked before but i damned if i can find an answer amongst all the topics on here so im asking again.
i have a bit of confusion in my tree (dont we all lol?) and i need some clarification. if a couple did not marry but lived as a married couple for all there adult lives woul the death cert of the woman have to be in that womans maiden name? i have a death record for 1987 so we are talking recently, but the name on it is her 'husbands' surname even though there is no record of them ever marrying.

She may have adopted the man's surname, either informally (you can call yourself by whatever name you wish, as long as there's no intent to deceive) or by deed poll.

On the envelope in which a death certificate is issued, it says,

"The registrar will ask for the following information about the deceased:

- date and place of death and usual address

- full names and surname (and maiden name if the deceased was a woman who had married)

- date and place of birth "

(plus a couple of other things not related to name)

You are not required to produce certificates to back up the names given.

So if someone adopted a different name from their birth name and was generally known by it, to the point that it appeared on their medical records and hence their death certificate, and if that name was given to the registrar - there would be no requirement to prove that the name was changed through marraige.

The death would therefore be registered in the name given to the registrar, who would not question that unless there were obvious discrepancies (eg the certificate showing one thing and the registrant saying something else!)

thank you that does help a little.
seeing as im here i might as well post some details incase anyone reading this knows of these people.
i have the births of elsie elizabeth west in 1905 in northamptonshire. i have her marrying a man called william t blyth in 1922. they had a daughter in 1931 called margaret eva, but her surname is west not blyth. i had been told that margarets mother was called lilian so i was a bit confused. on further research i found that elsies siter was called lilan may. on the daeth records i have for these two girls parents the informate is an L. Blyth. so i assumed that elsie had died and lilian married william later on, but that didnt explain margaret being born a west, unless lilian had her with thomas before they married.
on further research i couldnt find a death for elsie elizabeth blyth and i couldnt find a marriage for lilian and william. i have a death of a lilian blyth though, so i am now assuming that elsie ran off and william and lilian lived as married, but margaret name had to be west as lilain and william couldnt marry.
now if you followed all that your ahead of me!!!
