NSW Probate, Wills etc
« on: Tuesday 18 August 09 20:42 BST (UK) »
I'm currently researching my great grandfather who left scotland for Australia in 1911.  He remaried in Sydney in 1913 (I'm waiting for the marriage certificate to find out more) and  was widowed again in 1946.  He died in 1964 and I know he had property in Paramatter but it didn't appear to pass to my grand father back in scotland.  Is there any way searches can be done for details of wills or court papers for anyone that died intestate?  thanks

Hi Jerzy. Just read your post whilst looking for some information on wills and inheritences myself. I have a simlar dilema, that my family didn't seem to get their share of my great great grandfathers substantial property holdings in NSW when he died in 1928. I have done research at NSW State Archives before (I live about 1/2 hour away) and searched Probate Packets and deceased estate files. If memory serves me correctly, Probate Packets will give the run down of how ones estate was distributed according to the will, and also a copy of the will. I think the archives charge somewhere around 30 or 40 AUD for copies of them. Now, I'm no expert, but I think if they died intestate, then there might have been Letters of Administration granted to someone.

Did you search the links you were given? And did you find any reference numbers, or if he died with or without a will?

I will be going to the archives to look for my ancestor this weekend. If you would like me to look for your ancestor's probate packet/letters of administration then I would need his name, date, and place of death etc. Also what details you wish to get from the archives.

Let me know. Katharine.

Hi there,

If you use the online site for NSW State Records Office, and the Archives Investigator link below, and choose the "simple search" option, then use the Keywords option, with just two words,  the surname and death ... eg Smith death  AND then select ALL the words from the drop down menu ....

You should get the probate packet details, including all with that surname, and the display will include the date of death and the date probate was granted, as well as the probate packet reference (not every probate packet has been indexed, in fact many have not yet been, but it is a current project between the Supreme Court and the Archives)

Hope that helps,

Here's the link, hopefully direct to the Archives Investigator simple search

http://investigator.records.nsw.gov.au/Search.aspx

With the date of death, you can then check the NSW BDM online index for that year, and notice the recorded first names of the parents.  Often that helps too, but of course the info about the names of the deceased parents is not always accurate...

Cheers,  JM
