Arthur Murray (1786-1867) Blackhill, St.Fergus, Banff testament
« on: Tuesday 24 March 09 17:26 GMT (UK) »
Hello

Others might find the below of interest which is extracted from his testament on Scotlandspeople. He was my great great grandfather. I have never been able to find the details of his marriage to Elizabeth Slaiker, if others have and can provide this information I would be very grateful.

Testament and Inventory of Arthur Murray “sometime Farmer of Blackhills, in the parish of Saint Fergus”. Who died 30 Jan 1867.

The testament was drawn up on the 21 January 1867 (though not “finalised” until 04 Nov 1867). Written by William Brebner Clerk to Messieurs Andrew and William Boyd Solicitors in Peterhead at Blackhills. Witnesses were James Murray Farmer (his son) at Blackhills, and John Adams Servant to and residing with James Murray.

Sole executors were administrators were:

Alexander Watson Farmer in Northessie, Saint Fergus
Charles Buchan, Farmer in Keyhead, Saint Fergus

(For some reason there were restrictions on the payments to his son Arthur)

“In the first place I ordain my said executors or executor, within six months after my death, to set apart from the produce and proceeds of my said estate and executing the sum of One hundred pounds sterling, which I leave and bequeath to my son Arthur Murray: but I hereby declare and provide that my said executors shall deposit the said sum of One hundred pounds sterling in a bank to be selected by them, in their own names as my Executors, and that they shall pay the said sum of One hundred pounds sterling and the interest arising thereon, or on such balance thereof as may remain from time to time, to my said son Arthur Murray, but that only at such times and in such proportions and sums as they deem most for his advantage, of which they shall be the sole judges; hereby secluding and debarring my said son from interfering with my said executors in any manner whatever in reference to the discretion which they are empowered….”

Other legacies were:

“To my son Alexander Murray the sum of seventy pounds sterling”
“my son William Murray the sum of twenty pounds sterling”

Arthur was also left “the following articles of household furniture”:

A box bed
A table my chairs
Seven pairs of blankets
A chaff bed (whatever that is?)
A bolster and pillows
Three bedcovers.

To his grand daughter Elspet Murray residing at Blackhills he left:

A chest of drawers

“and whatever residue there may be of my said means and estate falling under this testament, I ordain the same to be accounted for and paid over to my son James Murray, whom I hereby decree to be my residuary Legatee”.

The “formal” extract inventory does not say much (figures were “finalised” on 01 Nov 1867), an just lists the monetary value of Arthur’s estate.
Household furniture and other effects £2
Balanced due to deceased on account current with Alexander Watson £104 2s 4d
Interest thereon till date of Oath to inventory £3 2s 8d
Balanced due to deceased on account with his son James Murray £147 9s 0d
Interest thereon till date of Oath to inventory £4 8s 7d

Total amount of Personal Estate £261 2s 7d

(I don’t understand the above, perhaps someone else can? I presume the amount owed by Alexander Watson is part of the £100 left to Alexander and Charles Buchan, as executors, to manage on his son’s Arthur behalf).

I also don’t understand why there is so much owed to the deceased by his on James, who was only to get any residual value from the estate).

Hello there,

I found this quite interesting, and although i dont understand much of whats going on with that will,

I am interested to know if you have more information on Arthurs son, Alexander, or even Arthur himself.

A friend of the family did some research for my aunt and tracked down Alexander Murray as my great-great grandfather.
Alexander Murray's birthdate is 1st august 1843 of blackhill, fergus, Banff, his birth witness is Arthur Murray of blackhill. Alexander married Isabella Salmon Dunbar in 1870.

The information i have states Alexanders father as another Alexander Murray who married Elizabeth Forbes on 29th may 1841 unfortunatly i have no sources that can cinfirm this.

Do you know if they are any realation, i imagine that Blackhill is most likely too small an area for it to be a coincidence. Just curious to see if Arthur may actually be Alexanders father or if they are uncle and nephew.

and information is recieved with gratatude.

A chaff bed (whatever that is?)
I ithink it's a mattress stuffed with chopped-up hay or straw

That is exactly what the Inventory is - it's a list, with values, of the moveable (as opposed to heritable - i.e. land and buildings) possessions of the deceased. Nothing more and nothing less.

No, it's nothing to do with that. The £100 would come out of the estate after the Inventory had been drawn up and valued and confirmation had been granted.

It looks as if Arthur has lent Watson some money, or sold something to him for which he has agreed to defer being paid, because as well as the principal sum, Watson owes interest till the date of - I think it's usually death rather than Oath. If you felt like raking through the Registers of Deeds, you might even find out what it was and why.

Arthur has probably handed over the tenancy of the farm to James, and perhaps lent him the capital to keep it going. The 1881 census shows James Murray, 59, born St Fergus, as farmer of 70 acres at Blackhill, St Fergus, and Arthur Murray, 55, is a cattleman in Strichen. It's quite common for an eldest son to seem to have been 'short-changed' in a testament, when in fact he has inherited the family farm and therefore got the lion's share of his father's assets.

Never trust anything you find online (especially submitted trees and transcriptions on Ancestry, MyHeritage, FindMyPast and other commercial web sites) unless it's an image of an original document - and even then be wary because errors can and do occur.

Hi

It seems entirely probable that they are related in some way but unfortunately I don't know how. For "my" Alexander Murray (who married an Isabella Clark) I have a date of birth of 10 Aug 1813 St. Fergus, Banffshire. From his marriage certificate I have his parents as Arthur Murray and Isabella Slaiker. For "The information i have states Alexanders father as another Alexander Murray who married Elizabeth Forbes on 29th may 1841 unfortunatly i have no sources that can cinfirm this" have you searched on Scotlandspeople for Alexander's marriage certificate as if it is on there you can download a copy of the marriage certificate which should confirm his and his wife's parents details. I have no record of "my" Alexander having a son called Alexander.

On LDS http://www.familysearch.org/eng/Search/frameset_search.asp?PAGE=igi/search_IGI.asp they have Alexander Murray's (born 01 Aug 1843) parents as Alexander Murray and Elira/Eliza (Probably Elizabeth) Murray (rather than Forbes). Again a search on Scotlandspeople should be able to confirm this.

On LDS it is possible to look for siblings of Alexander. Go to the link above enter the name Alexander Murray, Event as Birth/Christening year as 1843, Year Range as Exact, Region as British Isles, Country as Scotland, County as Banff then click on Search. The second result will be your Alexander. Click on this to highlight parents details, then on this screen click on batch number. A new screen will appeared will some of the details prefilled. On this screen enter the last name as Murray and father as Alexander, Select event as Birth/Christening, Enter year as 1843 and this time enter Year range as +-10. Click on search. This will bring up a list of the birth and and christenings of potential brothers and sisters of Alexander. These all seem to be born Blachill/St.Fergus/Banf with father Alexander and Mother Elizabeth, so would seem genuine candidates for brothers and sisters.

If you haven't used Scotlandspeople before you have to register and then can buy credits to search and view (1 credit to search, 5 credits to view/download search results). It costs £6.00 for 30 credits. Alternatively another Rootschatter who might already be a member of Scotlands people might be kind enought to look up the birth and marriage of Alexander for you. You can still get an initial free 10 credits by signing up for the newsletter here http://www.ancestralscotland.com/newsletter/.

Hi

Just one other thought. Arthur Murray did have a daughter Elizabeth Murray (born 1816) and brother to "my" Alexander. It is possible that she was the Eliza Murray that married "your" Alexander Murray, but as Elizabeth is such a common name it is difficult to say. But if the marriage entry has her parents and these are Arthur Murray and Elizabeth Slaiker then we have a match.
