Hi Forforian,

Yes she was certainly drowned, the point is she was ducked in spite of "the Jury not finding her guiltie of death". That's what I don't get, I'm wondering if it was (to paraphrase python) wood floats, so she should be burned and if she sinks then she is innocent type messed ye olde way of thinking. But if so, why the 'Jury'? It's very confusing.

Can someone explain the outcome of this to me with respect to Elizabeth? Am I missing something? The year is 1698 in Tarves, Aberdeenshire.

On a search being made Elizth. Burn’s child was found murdered and lying in her bed under the straw, upon which the Minr.  And other honest peopell being called to be spectators, after all she stood to a denyall ye she had murdered the child, but yt it was dead born.  The mater being evident yt. the child had been stifled, she was sent to Aberdeen to be kept in close prison till further tryall.  Being there periodically examined, the jury not finding her guiltie of death, she was ordained to be ducked at ye crann, which being done she departed this lyf, how soon the executioner had don his offis’.  Her master, John Leth, who confessed himself the father of the child, was tried also, but acquitted.  He, however had to appear 14 times on the pillory and before the Presbytery also and before being absolved was ordered to pay a fine of 20 merks (handwritten note in the margin by author states £3.6.8

I have the certificate with Rosy as a witness also. The only related Rose I have is the sister of the Elizabeth McMurray who is in that certificate. Her name was Rose Ann McMurray and would still have had the surname McMurray in that 1858 certificate since she, herself, didn't marry until 1874 at which time I have an index record of marrying William Kerr. My research suggests George McMurray was married to Jane Morrow or Moore (etc). George was a gardener and died 1871. Jane died in 1899, both in Belfast.

What is really interesting is that George McMurray died on 17th May 1871 on Combermere Street. This location lies about 2 miles south of his probable residence in Springmount Street. On digging a little I discovered that the address in Combermere Street was laterally resided by a James McMurray. Until now, I had nothing which identified who James McMurray was but, if you have already established this, I would be delighted to see what evidentiary link there was. For info the complete family I have in my research is:

George McMurray abt 1820 to 1871 (Gardener)
Jane Moore or Morrow abt 1821 to 1889
Children:
Elizabeth McMurray abt 1840 to bef 1900 (m. Charles McTrusty 1858) < My relatives
Rose Ann McMurray abt 1840-? (m. William Kerr 1874)
George McMurray abt 1844-1906 (m. Jane Matilda White 1869) - painter & cloth printer
Thomas McMurray abt 1848-? (m. Annie McGimpsey 1871) - Shirt & collar cutter
Margaret McMurray 1850-1913(usa) (m. George Little 1870 usa)
Ellen McMurray 1856-aft1919(usa) no record of marriage found.

Obviously I'm keen to avoid cross-overs of families so anything you can find which rectifies my own research would be appreciated. If relevant I have a Thomas McMurray who was a sailmaker and married an Elizabeth (unknown) who may relate to the other George.

I have a tree on ancestry called the Brennan Tree which is public and will afford you more detail.

Your quite right, I have Alexander Penman aged 33  from 44 Thistle Street on the 1901 census (making his yob 1878-ish) This would almost certainly make him the uncle of the Alexander I initially referred to (there are good reasons for this basis - I'm not just makingit up).

That said, if the younger one was to be in the infantry during the war he would be between 19 and 23 in that photo. If it were the elder (uncle) then he would be (based on the 1911 census age) between 37 and 41.

I'm slightly inclined towards the latter given the lack of data for the former (I assume you 70% loss of records related to WW1 and not WW2 as you mentioned in a previous post?) The likeness of the two in photos can be explained by how closely related they are... the attached is from 1951.

That being true it's going to make that photo in some 10 trees wrong LOL

His address at the time of war was 46 Thistle street which is very similar to 44 Kirtle Street? I'm intrigued..?

It's not any of the brothers because the next oldest (who made it to adulthood) was born in 1901 which makes him too young to really have made it into that uniform without being obviously teenage-r-ay.

Jebber, My biggest problem is that I have the name for this chap Alexander Penman, born In Cowdenbeath born 20th July 1895. There are two military entries for an Alexander Penman's born in Fife for around that time, except one is born two years previously (still in Cowdenbeath and having a father named 'James' later changed to a "guardian" by another name in 1917. The second one is from Dunfermline and, as i recall, using the middle initial "D" which doesnt apply here. My one was single unitl he wed in 1919 (a fact in itself suggesting he was possibly in service)

Feel free to have a look around for me since military records arent really my bag so to speak and any help in that regard would be appreciated. In the absence of an Army record (as the clarification of the cap badge now asserts) then there can only be three conclusions. One, his records are entirely lost - and I mean all of them ! - Two, he is wearing someone elses uniform as a photo op (which I'm obviously reluctant to assume) or three, he isnt the man I was told was in the photo. The photo of him 32 years later is a dead ringer but that doesnt discount it being perhaps being one of his brothers but then I wont have anyhting to compare it with and he will likely look just like them anyway!

The final option is I'm simply not looking in the right place for his army record.

Can someone identify the likely armed forces that this subject belonged to? Note the heavy coat, chest ammo belt, stirrups and a cap badge which may be a normal infantry badge or something I couldnt find which I reckoned may be an eagle looking to one side, just to blurry to tell for sure...?

Any help greatly appreciated.

PS He was from Cowdenbeath in Fife, Scotland if that makes a difference...

Here are a couple of pictures which (again I'm running from memory) are of the same person. One which has pretty good detail on the dress despite the fading (neck brooch, shoulder flappy things etc) and a really conservative hair do. Also, the doorway photo was taken by the Greenfields of Edinburgh. I dont have a date but the earliest possilbe date I have for them being at 5a Annandale Street is 1893 and they stayed there for a good 40 years. This make the subject (if my info regarding the 1839 birth is correct) at least 60 and she looks about 80 in the photo! She lived until 1913 (i.e. 74) so I suspect it was closer to that date. Hopefully this can back track assist the earlier photo..?

Well spotted but it's poor quality is by virtue of it being an inket printout I was given years ago. I cant get hold of the original owner of the image to try and procure somethine a bit better, so, unfortunately this is all I have to work with... :(
