Westmorland / Re: Richard W WARD of Kendal 91843-1917
« on: Monday 04 February 19 10:39 GMT (UK)  »
I just noticed your query re one of my earlier posts. The detail came from several newspapers, as follows:

The Kendal Mercury (3 Jan 1846) recorded the death of Elizabeth, her age and her relationship to the late Mr James WILSON, of Viver, Heversham.

The Westmorland Gazette (24 Oct 1840) recorded the marriage of James junior, son of the late Mr. James WILSON of Viver. Other newspapers record his death and his widow/children were found within census returns.

The Kendal Mercury (7 Apr 1838) and the Westmorland Gazette (7 Apr 1838) both record the death of Mr James WILSON of Viver.

Probate references can be found on the Lancashire Archives website (  http://archivecat.lancashire.gov.uk/calmview/advanced.aspx?src=CalmView.Catalog ).

There was an Isabella, daughter of John & Margaret PARK of Lupton, born on the 20 Apr and baptised at Mansergh on the 20 May 1804. Similarly, a son Joseph (b. 17 Dec 1805, bp. 2 Feb 1806), a son Thomas (b. 15 May, bp. 5 Jun 1808), a daughter Sarah (b. 1 Feb, bp. 8 Apr 1810) and a daughter Margaret (b. 22 Feb, bp. 24 Feb 1812). Familysearch lists later baptisms within Mansergh for Barbara (1814) and John (1816) and perhaps others within Longsleddale (see ref. to later census return).

With no chapel in Lupton, it was common for baptisms to take-place nearby within Mansergh or Preston Patrick. Therefore, it is likely that Hannah (b. 28 Jan 1802, bp. 25 Apr 1802 Preston Patrick) belongs with the above family.

John PARKE (of Lupton, husbandman) married Margaret DICKINSON (of Lupton, spinster) at Kirkby Lonsdale on the 5 May 1800 following banns. Both signed, witnessed by Edward BRIGGS and Miles CRASTON.

The 1841 census returns appear to show this family at Edge Bank in Skelsmergh: John PARK (65+, farmer), Margaret (60+), Barbara (25+), George (20+), William (20+), with Elizabeth (3 months) and a Thomas MACHELL aged 5, all born within Westmorland, except Margaret.

In 1851, a John and Margaret PARK were at Dubside in Hutton in the Hay, with their son Christopher. This Christopher was a farmer of 7 acres, a widower, aged 27 and born in Longsleddale. His father, John, was a retired farmer, aged 75 and born in Hutton Roof, while his mother, Margaret, was aged 72 and born within Cartmel in Lancashire.

If this is the correct family, then there was a John PARK born on the 26 Nov and baptised in Hutton Roof on the 24 Dec 1775 the son of Joseph & Hannah PARK.

Joseph PARK of Newbiggin in Hutton Roof married Hannah ROBINSON of Farleton p. Beetham, in Kirkby Lonsdale on the 5 Aug 1775. They were married by lic. (with surviving marriage bond), he signed, she marked, witnessed by Chr? ROBINSON and Robt. GREENWOOD.

It seems likely that this Joseph was a grandson of Joseph PARK (curate of Hutton Roof, who died in 1722, having married Isabel WARRINER in Kirkby Lonsdale in 1716).

The Elizabeth WILSON who died within the Kendal registration district (Dec 1/4, 1845, aged 19) was the daughter of James WILSON (maltster and miller) of Viver, Heversham. She died on Christmas day. Her father died at Viver on the 30 Mar 1838 (aged 53) and her brother James died at Croft farm, Leasgill on the 10 Feb 1846 (aged 28, of small pox). Neither James left a will, yet administration bonds exist for both.

James WARD & Catherine FARRER married in the chapel of St John, Firbank, on the 25 May 1795 - following banns. Their marriage entry was witnessed by James WARD and Joseph FARRER.

James & Catherine had the following children baptised in Firbank:

1. William (b. 7 Aug, bp. 30 Aug 1795),
2. & 3. Mary & Margaret (b. 29 Jan, bp. 29 Jan 1797),
4. Ann (bp. 20 May 1799) and
5. Agnes (b. 21 May, bp. 31 May 1801, bur. 22 Oct 1801).

Catherine FARRER appears to have been baptised in Grayrigg on the 28 Dec 1769, the daughter of Joseph & Margaret FARRER.

James WARD (of Firbank, aged 69) was buried in Firbank on the 20 Nov 1825. The Lancashire Record Office Probate-index appears to confirm that this was James WARD of High House in Firbank, Yeoman, as probate for that James was granted on the 24 Dec 1825. The James of High House left a will. Order forms are available from their website.

If this is the correct James, then he was surely the James baptised in Firbank on the 7 Nov 1756, the son of William WARD of High House. William was the eldest son of Richard WARD of High House (Will: 1729). There are earlier wills for WARDs of High House dating back to the 1650s as well as wills for other WARDs of Firbank - who appear to be related.

Ann WARD married John WOOF at St Michael, Beetham on the 29 May 1830. John was baptised in All Saints, Killington on the 5 Jul 1795, the eldest of two sons born to John WOOF & Agnes TEBAY. The WOOFs were from Firbank, while the TEBAYs were from Killington (earlier from Sedbergh).

I agree maddys52. Richard - the son of William & Ann WARD of Kendal, cannot be the Richard WARD of Middleton in Lancashire. As far as I can tell, William WARD of Kendal was the son of Richard WARD & Mary READ. His father Richard was one of two bondsmen bound by the probate of William WARD (husband of Ann BRAITHWAITE) who I mentioned in a previous post. Note that another branch of this family also went to Durham.

Within my previous post I referred to the will of John WARD of Middleton. Perhaps if there really was a WARD connection (with Kendal), then this connection may be clarified within his will. However, I'm currently unable to find any connection between the WARDs of Middleton and those of the Kendal region. Actually, I'm unable to find any (other) connection between the WARDs of Middleton and Kendal.

Does anyone know anything about the process of adoption at that time?

John WARD (butcher and shopkeeper) of Middleton left a will, probate dated the 3 Oct 1853. This is held at the Lancashire Record Office in Preston. The reference number for his probate is (WCW/1260B/65). You can contact them via their website and obtain forms to order copies at ( http://www.lancashire.gov.uk/libraries-and-archives/archives-and-record-office/order-a-copy.aspx )

Just a brief comment regarding your initial post and the marriage of William WARD & Ann BRADSHAW. William and Ann had both been married previously. Ann was buried in Kendal (Holy Trinity) on the 10 May 1822 aged 47 and William on the 1 Nov 1826 (aged 69 (according to his burial record) or aged 79 (according to a newspaper death notice)). William's first wife was Sally BIRKETT {WILSON}, who was buried in Kendal on the 6 Dec 1811 (aged 52).

Have you viewed any of these probate records?

Thomas BIRKETT (of Lambrigg Park, husband of Abigail). Probate 18 Sep 1756. Contains (W, I, A)
Richard THECKSTONE (shoemaker of Dowgill, Firbank). Probate 3 Mar 1738. Contains (A, I)
Margaret THEXTON (spinster of Dowgill, Firbank). Probate 24 Apr 1740. Contains (W, I)

If not, then perhaps you may be lucky and find hints within the wills.

Note that the name Abigail is present within earlier HELME and AIREY families (Quakers) of the region. Although I have no other evidence for an Abigail FAWCETT (of an appropriate age), I wouldn't dismiss this surname on the basis of the parish marriage entry. I have found a somewhat similar case, where the name on the marriage-bond was different from that within the register. However, in this particular case, the wife-to-be's surname was recorded three times within the bond as HAISTING. Sometime later, all three were crossed-out and the name ASHTON placed above - which is the name as it appears within the register. Note that the register also records her as a widow. A little over a decade later a Richard ASHTON  (from the same small parish) was buried, being recorded as Richard ASHTON alias HAISTINGS. Therefore, the original entries within the marriage-bond may not have been in error after all.
