Hi snowyw, where did you find this?

I wonder if it will allow me to add to my present  one which is up to 2016?

Click on where it says about your subscription with expiry date at top.

msr, do you have a World subscription and not a UK one?  I've just tried it and its extended by UK subscription by another year. ;D

Groom, assuming you have a UK subscription (as it would appear to be for that), click on the link at the top that says Britain Subscriber until ....  It then presents you with the subscription page and you can apply the code at the bottom under the rates for pay per view.  It then amends the yearly subscription price.

Thanks snowyw. ;D  Now subscribed until 2017. ;)  I made use of the half price offer in July, but this is better still.

Brilliant!  What with a half price code earlier in the year and my (current) 6 months free extensions I am now a member to Jan 2017.

I hope they manage to sort out the mess by then.  At £10 it was definitely worth extending my sub.

Can I just ask at what point you add the code. I started trying to do it, and alarmingly it seemed to go straight to payment after I'd added the card details. But, my bank refused to make the payment anyway, but thought I would ask before making another attempt. I have just been subscribing on a month by month basis.

My payment wasn't accepted either and I got a call from my bank to contact them.  My card had been blocked so you may need to check.

Everything OK now though.  Thanks Snowy - great deal.

it didn't work either with or without auto-renew for me.

I have got unused credits which might be causing the glitch.

I acquired the credits a good 2or3 years ago when I didn't have a sub, they expired but as soon as I got a sub they resurrected.

I have the same Dawn, 206 unused credits which have reactivated when I added the £10 sub. I can't remember how I got them but they seem to be World ones. Have you tried getting into the subscription bit the way msr did when it wouldn't accept her code?

Of course, perhaps they have been inundated with requests and have stopped the offer.

I have unused credits which I have had for ages but I did have an annual sub when I got them. Now they show on my account details as running until Oct 2016.

The other day I unticked the box to see whether it generated an email - it did, I left it unticked.  Today I have taken advantage of this offer and have just looked at my account and the box is ticked. There is no mention on the email extending my membership until 2016 about the 'auto renew'

Hi,
Maybe you are right? Perhaps some of us just got the offer at the right time?   I put the code in the at the bottom of the page (under the pay as you go area and then went back up the page and clicked on the year's subscription box, filled out the relevant information and it worked okay for me.  It also reserected some credits I had not used from some freebie awhile ago.  It's odd. :-\

I had let my sub expire some time ago after the changes.

Post by: jennywren001 on Tuesday 09 December 14 15:49 GMT (UK)
You have to wonder how their system works?  I've never had a year's sub - I only ever take out a month when it's on offer and I always uncheck auto renew-  therefore not one of their more profitable customers.  So, no offer of a year sub for me but it did offer a month for a £1 - I've used the code four times so far and I'm now extended to April 2015. Might just carry on.....

panic posted on the previous page of this thread that the code appeared on a blog in relation to a monthly sub, I wonder whether it shouldn't have worked with the annual subscription and that's why it's not working now as they realised the error. :-\
Title: Re: FindMyPast subscription £10 for year
Post by: groom on Tuesday 09 December 14 16:14 GMT (UK)
Could well be smudwhisk, it does seem a very generous offer. If it was a mistake, lets hope they honour the subscriptions that have been renewed/extended.
Title: Re: FindMyPast subscription £10 for year
Post by: smudwhisk on Tuesday 09 December 14 16:21 GMT (UK)
I suspect they will even if its to avoid any more negative feedback about the company.  They were purchased in good faith and if the error (assuming it was an error) was caused by their site, which seems a good possibility, its not the fault of the purchasers.  They've had quite a few £1 for a month offers this year anyway that I suspect many have taken them up on these rather than purchase a full subscription.  Its not really much different to someone purchasing multiples of these.
Title: Re: FindMyPast subscription £10 for year
Post by: groom on Tuesday 09 December 14 16:25 GMT (UK)
It does seem as if there was a fault somewhere, especially if it was possible for people to use the code more than once and so renew for several years.
Title: Re: FindMyPast subscription £10 for year

The half price offer in July worked more than once for people as there were several posts on various forums/social media from people confirming this.  And jennywren001 has posted the monthly offer is working more than once today too.

Its interesting that they are allowing them to be used more than once because in the past they've restricted at times who could use the free credit offers.

May find that these get restricted subsequently too.
Title: Re: FindMyPast subscription £10 for year

Trystan

I hope not but anything's possible.  In theory I would have thought once they issued the confirmation email it was a completed purchase bought in good faith.  Its only subsequently that its been realised perhaps it was an error on their part.  Unlike with physical goods, they're not delivering anything other than access to the site but I suppose the law may allow them to claim it was a mistake.  The inactive subscriptions I suppose could be revoked but its a little unfair when the error was theirs and their system allows them to be purchased.

As I said previously, there have been so many £1 per month offers this year anyway, its no different to someone just using them each time their existing subscription expires.

We shall have to wait and see but I'm hoping they won't revoke them.

Post by: jennywren001 on Tuesday 09 December 14 17:09 GMT (UK)
Just in case you've managed to do multiple monthly £1 offers ( I stopped at 12) :).  I suspect they will be treated as a individual monthly subscription so EACH month you will need to check that the auto renew is unchecked.

Just nabbed myself a bargain, I've only ever had pay as you go subscriptions so I assumed that was why it only offered me a month for a pound on this offer. A whole month for only a quid, I'm very pleased  :D

It reinstated 105 expired credits too, I was thinking there wasn't much point in that as they will expire at the same time but found that they're worldwide whereas the £1 subscription only gives me Britain.

Chuffed, thank you  :D :D :-*

The discount on the annual sub has been withdrawn as it looks like it was working in error.  Roobarb I believe got a month sub discounted to a £1 and I believe this should still be working.

I've used the "report to moderator" facility to ask the mods if they will amend the original title to reflect the fact the discount on the annual sub would appear to have been an error and it was only on the monthly sub.  There doesn't appear to be a dedicated mod for the Common Room so I hope one picks up the request, it may stop a lot of the posts saying it doesn't work. :-X

The last few pages of this thread clearly indicate that its not now working on the annual sub, and hasn't been since before 3pm yesterday.  I appreciate there are a lot of posts but even the last few posts indicate the discount code is only working on month subs not annual.

Not sure Wiggy, but it looks as if it has been withdrawn now anyway. If it was offered in error, I expect someone is feeling very embarrassed now as they have probably lost quite a bit of money as it was such a good offer.

Someone posted on FindMyPast's Facebook page that the code wasn't working and got a reply from them saying it was only off the month sub.

So it does look like whoever set up the discount code applied it to the annual subs in error. :D

I have just tried the code and managed to get FindMyPast for a month for £1, I am happy with that.  :) :D

I have subscibed to Ancestry for several years, but this year I have been using FindMyPast at my county records office for free, I also registered myself for the free weekend FindMyPast offered over Halloween. My strategy now is to jump on these bargain offers whenever they come up as having access to more than one of the big subscription sites really helps with the research.

Once the month is up, I will still be registered to FindMyPast and will just wait until the next deal.

Thanks to Roots Chatters I managed to get BNA at £40 (half price for a year) about a month ago.

Hello rolnora,

After entering the Code, click on the Select button, for the Monthly Subscription, then the Payment Section should appear.

Not sure if they can do that, as I have an e-mail which says it is a receipt for the £10 for 1 year Britain subscription, so presumably that is a contract. If I tried to cancel I doubt if they would refund the money.

I give up, FindMyPast are just not playing nice  :(

rolnora, if you read some of the recent posts you will find that the offer appears to have been withdrawn amended because it should have been against the month sub not the annual.

Yes it works for the monthly but the topic says annual.  This is where the problem lies.  The topic title either needs amending or something added to say that it is monthly only as people seem to still not be reading recent posts and thinking its for the annual sub.

It might reduce the number of negative comments about it. ;)

Edit - there have been people posting on FindMyPast's Facebook page in the last hour asking where the annual offer is.

We're not modifying the subject title (sorry) as the topic has already been indexed on the search engines, and the topic (with the title) has been widely shared on social media.

www.google.co.uk/search?q=FindMyPast+subscription+£10+for+year (http://www.google.co.uk/search?q=FindMyPast+subscription+£10+for+year)

Offers like this by their nature have a limited time, and as many people discovered they were able to take up this brilliant offer of £10 for an annual subscription. Even the £1 sub for a month is a great deal.

Yes I think you'll find it was an error on the annual sub rather than a limited time offer, but I agree the £1 for a month is a good offer too.

Especially as they dont seem to have closed the loop that lets you keep adding a £1 month.   Add a month for £1.  Do it again, and again.  It keeps letting you.  Try it before they realize ;-)

I have just received an e-mail from FindMyPast support team and the discount was only meant to be on the monthly subscription. They are aware that some customers did use the code for a 12 months option and shall be contacting those customers directly to advise them of any decision they have made regarding that payment. So to all the people who were successful please let us know what they have to say, when you hear back from them.  :-*

Thanks Ellen, it will be interesting to see what happens now then, as from what I've read, as they accepted the money and issued an email saying that the subscription was in place, that it could act like a contract and they may have to stand by it even though it was a mistake as people paid the money in good faith. I suppose it depends how many people were able to take advantage of the offer, whether they can afford to let it stand as a gesture of good will. I expect they will take legal advice before doing anything.

I wouldn't like to be the person who put out the offer!!

Findmypast may have a legal out if they did not actually make the offer of 10GBP for a years subscription. The only place I have seen an offer with that code is in the FFHS Ezine email and that said   Get started today for just £1 using the code ‘FHSANTA14’. Code expires 2 January 2015 It does not state a subscription period but would have been meant for a 1 month subscription, someone may have accidentally found that the 90% discount intended for the 1 month subscription also worked on the 1 year subscription and so it spread.

This is the offer I saw, but when I entered the code, it displayed 1 month for £6.95 and 12 months for £10.  It never entered my head that it was their mistake, I just thought I had read it incorrectly.   ::)

I think some one just made a huge mistake, presumably their computers must have been programmed to allow it to be added to a year's subscription, otherwise why didn't it come up straight away as void?

may? would have meant?

are you kidding? This is part of DC Thompson, they don't deal in puzzling their customers.  Companies HOPE for word of mouth, for good reviews to get around, for special offers to get around.   I don't know where snowy, the originator of this thread found the offer but was perfectly entitled to share it here. Plenty of people took advantage and shared again and why shouldn't they? The fact that FindMyPast had no brakes on this offer, either by scrutinising before release or confining it to one offer per customer is not the customer's fault.  Once again they have shown they are slack and unprofessional.

I can't believe its the same company of 12 months ago.  Sad.

Parmesan, considering you have such a low opinion of the site and the company, why did you bother taking them up on the offer?  And, for that matter, twice as you've admitted previously on this thread.

The more negative feedback over this error, and lets face it errors do occur on a lot of sites and in other computer services, the more chance they will try and revoke all the subscriptions.  Their T&Cs state that the contract is concluded when they send out a confirmation email, something which is no doubt though automatic.

Rather than people speculating as to what is going to happen, and it is still speculation whatever has been posted on a certain Facebook page and whatever the impression given by FindMyPast Customer Support in emails to those who weren't lucky enough to make use of the discount on an annual sub, perhaps people should just wait and see and hold off on any criticism which may adversely affect the position of those who did manage to take up the offer in good faith.

Hello RootsChatters,

The Offer was also available on this site:
http://www.retailmenot.com/view/findmypast.co.uk?c=6475426

I hope all goes well for everyone who were able to secure the Membership for the Year.
I missed out on the Yearly Offer, as I was assessing the situation, a little too long.
However, I did take them up on the Monthly Offer, which I have done so previously.
This suits me fine, it works well with the unlimited access for Britain and I also still have Credits with my World Pay-As-You-Go Yearly Membership, which will keep me going for a while, until the next offer comes along or Free Access Weekends (if any?).
I keep hoping 'Ancestry' or 'Scotland's People', may one day be a little more generous.

Just received this:
I write in connection with a Findmypast subscription purchase that you made earlier this week.
The terms and conditions of this particular promotion stated that it was intended to give you a 90% reduction on a 1 month subscription so, 1 month for £1.
For a short period, it was possible to use the discount code for a purchase of an annual subscription and I can see that you have managed to purchase a £99.50 subscription at the price of £10.
That was our mistake and I have now corrected that by refunding your £10 payment and cancelling that annual subscription. That credit refund should reach your card within the next 2 or 3 working days.
We are sorry for any disappointment caused by this error and we have taken steps to ensure that an error of this kind does not occur on future discounted promotions.
With kind regards
Nicky Doran

My reply:
Not acceptable.
The offer was advertised by FindMyPast  & paid for by subscribers which constitutes a contract.
As with any sale of goods or services that which is advertised must be honoured.
I do not want nor do I accept a refund & I expect FindMyPast to honour that which was advertised.
Do not remove my annual subscription as this will constitute a breach of the code of practice.

I haven't been given a months complimentary.

I expect you will find, Jim that your subscription has already been removed, I checked mine and it is back to October 2015.

As I understand it, it is not the advertising that must be honoured, as that is only an invitation to buy and they don't have to accept your offer. What could be a contract though is the fact that they took the money and sent out receipts in the form of emails. However, as I said earlier, I presume that they have  sought advice from their legal department before acting.

If there was no sub for £10 why did they say the voucher had been applied (as advertised)? Why did they deduct £89 from the 1 year price when the voucher was input?  Why did they add 1 year to accounts? Why did they take £10 from bank accounts?  Why did they confirm on their website and by email that a 1 year subscription for £10 had been awarded?  That is a lot of whys?

Why did they take £10 from bank accounts?  Why did they confirm on their website and by email that a 1 year subscription for £10 had been awarded?  That is a lot of whys?

Certainly is Pat, but correct.

I presume that Jay9 didn't apply for the offer otherwise they would have known what was said when the code was applied. I agree, it was a good offer, but as they have been offering £1 for a month for quite a long time as well as free weekends,  it didn't seem unreasonable that they offered it as a reward to loyal customers, rather than offering bargains all the time to non subscribers. Majority of us didn't take advantage by applying the code more that once.

Mine was withdrawn in line with others on here - I contested & showed them the advert from the voucher site .... (linked in an earlier post on here)  ... heres the response ...

Quote
That was not an advertisement placed by Findmypast, it sounds like inaccurate information has been placed by a third party on another website.

The terms I was referring to were those that were agreed with FFHS when the promotion was agreed with them – the offer was £1 for 1 month.

We did not advertise anywhere that this discounted offer was in respect of an annual subscription at £10 so we are entitled to withdraw the purchase and refund in full.

We just couldn’t honour such a massive discount of almost £90 for an annual subscription.  Our product is worth far more than £10 per year. We would not be able to stay in business long, nor indeed invest so heavily in the many record sets we are adding if we charged such a low price for a Findmypast annual subscription.

Finally, please be assured that we have taken steps to ensure that an error of this kind does not re-occur. It’s clearly a bad reflection on us as a company and is time consuming for myself and my team to try our best to rectify.

Whilst I agree that it's frustrating and they've certainly screwed up, I don't think any of us would want to see FindMyPast go out of business due to losing massive amounts of money.

Just remember the saying "There's no such thing as a free lunch" - or in this case a free (ish) subscription.

I too managed to obtain a subscription for one year, which has now been withdrawn.

I have, however, been offered one month free:

Quote
I write in connection with a Findmypast subscription purchase that you made earlier this week.

The terms of this particular promotion were to get you started with Findmypast for £1 on a monthly subscription

For a short period, it was possible to also use the discount code for a purchase of an annual subscription and I can see that you have managed to purchase a £99.50 subscription at the price of £10.

That was our mistake and I have now corrected that by refunding your £10 payment and cancelling that annual subscription. That credit refund should reach your card within the next 2 or 3 working days.

We are sorry for any disappointment caused by this error and in recognition of that, and as a goodwill gesture, I have now added a complimentary 1 month subscription to your Findmypast membership.

I hope that will afford you enough time to have a good look at Findmypast and decide if you want to make a further purchase with us.

My response:
Quote
Thank you for your email.

Frankly, I am disappointed with its content. I saw the offer and purchased it in good faith.

You have stated that it was an error on the part of DC Thomson Family History and so not my fault. Therefore, why am I being penalised for your mistake?

Any goods and services that are purchased for an advertised price - whether in shops or on the internet -  should not then subsequently have the terms of the sale changed. Otherwise, other goods and services purchased through online shopping, which is what this is, could have money refunded or withdrawn from accounts with no notice of intent.

You have also stated in your email that, as a goodwill gesture, a complimentary one month subscription has been added to my account. This is not true. You have extended my current subscription to 10th January - a mere 11 days after it is due to end on 30th December. That is not a one month goodwill gesture, is it?

I took out my original subscription with Find My Past because it was owned by a British company and I do believe in supporting the home economy rather than one based on the other side of the Atlantic Ocean. Since doing so, the site was "improved" and I have spent the past year getting to grips with the changes and glitches that came with it.

Yes, I will take a long, hard look at the website and make a decision as to whether or not I continue to use it. If I choose not to renew, I will certainly ensure that my reasons are documented.

I would appreciated a response to the questions that I have asked above.
I will now wait to see if I do get a response.

Once again a case of loyalty not being rewarded.

Try being a World subscriber - you don't even get a chance at the £1 for a month, or any other offer for that matter, and the non-UK records are fairly pants anyway as it turns out.

So I asked them to down-grade my sub to UK only without any refund of payment, but guess what, they "can't".

I did get an email about an offer with Debenhams for £49 which said "your membership will last one year from point of redemption" so I going to buy it to use when the World sub ran out, but elsewhere it said 6-months so I checked with them before parting with my cash - just as well, it is only 6-months.

They really do need to get their act together.

It is a fallacy that a trader has to sell something at the marked price, if it is an obvious error then they do not have to.
The sticking point here is wether they and the purchasers have contracted an agreement for the purchase price, again the get out may be the obvious mistake in the price.
And don't forget, it cuts both way's, so when you have overpaid will they refund you!
Title: Re: FindMyPast subscription £10 for year

They treat customers so erratically.  When it all went horribly wrong some got multiple ongoing extensions (me included), some none. One or two got refunds, the majority did not.  Those people paid for a service they thought they knew but it had changed out of all recognition and they found it unworkable.  Did FindMyPast listen to them? No they did not (except for one or two who wouldn't let it drop, or moaned as people on here called it).

I keep hearing 'we are a small company' boo-hoo! (and don't make me laugh)  Many of their subscribers were pensioners or on low incomes and couldn't afford to pay money for an unusable product. They care not one jot.

They don't actually seem to know who they are.  The website says "© 2014 brightsolid online publishing limited, trading as findmypast.co.uk" and quotes Company No. 04369607 - but this number is in fact D.C. Thomson Family History Ltd.   They used to be called Brightsolid Online Publishing Ltd but haven't been legally called that for almost a year now........

So basically we are dealing with a company that doesn't even know its own name yet we hope to get some sense out of them.   Good luck with that one then.  ;D

A mistake would be where they mistakenly charged the wrong price  and it was obvious that it was a mistake- not when they offered a sub at a price and set up an entire process to enable them to offer at that price.  How are purchasers supposed to know around Black Friday, Cyber Monday et al what constitutes a ridiculously implausiible mistake and what is a really brilliant offer?
There is no sticking point over whether they contracted an agreement.  An online confirmation of "you have successfuly applied your voucher, congratulations you can start your search now" and a letter stating a price paid and accepted and a timebounded subscription period is contract enough for me.
And does it cut both ways? - if it does why is someone on Find My Past Facebook in dispute because they have been charged £90 for a free offer.
If Find My Past has accepted that this mess is their fault then they need to deal with that fact and not blame customers for taking advantage of what looked like a really good offer.

"£90 is a lot for 14 days, did they not untick the auto renew box?"

In a nutshell, apparently they signed up for 14 days free trial to see if things had improved since they were last a member. It did start with failure to uncheck auto renew, I think but before the end of the 14 day period.  So they posted on Facebook and were advised to contact support, told they shouldn't worry as if they had inadvertently purchased a full sub that they didn't want, they would get a refund.  When they contacted FindMyPast support they were told they could not have a refund and that they had not been eligible for a free trial anyway as they had previously been a member of FindMyPast.  The individual did not find anything limiting the free trial in the terms and conditions.  The only restriction is that a free trial is limited to one per household and as they had not previously had a free trial they did not see a problem. They posted again and were told, again, to contact support.  As yet they have not received satisfaction and apparently are dealing with Trading Standards although a subsequent FindMyPast post on Facebook says that the head of customer services has written to the individual regarding the matter. That's as much as I know.

I have no knowledge whatsoever of this apart from what you have posted, so without making assumptions I cannot judge who is right or wrong.

Back to the original subject, can you imagine how many thousands of pounds that would have been lost due to this cock-up. There were postings on other forums, not just this one and it was posted to facebook amongst other social media sites by many. With the multiple subscriptions made by several people also it must number in the tens of thousands.

But can you imagine how many thousands of pounds it will cost in staff time, resources, bad publicity etc by the time that they have resolved the issues? It might well have been better for them to have cut their losses and left the £10 deal to those who had snapped it up.

Yes, I can and I do understand that it would be difficult for a company to sustain such losses but they could certainly have handled the fall-out better and treated people equally.  It wasn't that this was a £1 offer for a month that went through at £10 for a year - once on the purchase page there was a choice £1 for a month or £10 for a year.  It wasn't as if people were exploiting a bug in the system, this was presented as a genuine offer.  FindMyPast have acknowledged that it is entirely their mistake.

It wasn't advertised as a genuine offer by FindMyPast, it was posted on here, and possibly elsewhere, and then reposted on various other Facebook pages and probably elsewhere.  If you check the first page, someone did ask the OP where they saw it and they didn't respond at that time.  The online voucher sites had obviously picked it up from somewhere and reposted.  The fact they provide a percentage of how many people were successful at using the code does show its unlikely to have been a genuine advertisement placed by FindMyPast.  Most of these sites do seem to repost the offers they see.

The offer code was advertised on the FFHS Ezine in relation to £1 offer, although that didn't specifically say for one month, but considering the number of £1 for a month offers that there have been this year, most people would realise that was probably what it was for.  OK most of us weren't aware of this until after the facility was pulled but that doesn't mean that FindMyPast advertised it as such.

FindMyPast appear to be relying on the fact it was a misprice on their system and some contract law that appears to allow them in certain circumstances, because it was such a big discount, to argue that it would not be reasonable to expect them to have genuinely made the offer.  The fact they never actually advertised it themselves, but it was their system applying the code to the wrong subscription level, would probably work in their favour.  I've been trying to find a link to the appropriate legislation to do with mispricing on the web to see what it actually says but haven't been able to find one as yet.  However, the Which article that a RCer posted on a previous page of this thread is a good overview of the subject and there are other webpages that discuss it, although these apply to the sale of goods and not services.  They do seem to say that in the case of a misprice, all orders have to be revoked as nobody should be able to benefit from the problem.  This is most probably why they have revoked not only the subscriptions of those of us who used the code to extend an existing subscription which would start at a later date, but those who didn't have a subscription and obviously started to use it immediately.

I know FMPs T&Cs state that once you get a confirmation email the contract has been accepted, but the crux of the issue will be what the mispricing rules in the legislation actually say about this and how they would likely be interpreted by a court if it ever went to court.  The fact that the mistake, and it was that, allowed far more people to benefit from the big discount that the normal £1 for 1 month offer would, probably would act in their favour as they would argue that no reasonable person would realistically expect them to discount an annual subscription to such an extent (there hasn't ever been such a large discount on the annual previously, only a 50% discount) and take such a loss.

If anyone really wants to find out, then contact the CAB or a solictor and ask, but to those overseas please note this is covered by the law in England as that is where findmypast itself is based (its their parent company which is based in Scotland).

This is simply my interpretation of what I have read in relation to this, I'm not a qualified solicitor.

Don't get me wrong, I don't think FindMyPast have really dealt with this in a good way.  There has been no public comment that they had an issue, its all been limited to individual emails to people affected and I do think their emails outlining why they were revoking the subscriptions could have been much better, not least stating the appropriate legislation which would allow people to satisfy themselves as to what it does actually say.  I don't think their T&Cs are that good either, so much for reducing jargon.  I suspect there will be a major rewrite of them at some point to cover their backsides more easily if such an issue arose in the future.

I'm not sure about this -

The codes have to originate somewhere, and the most likely place is the company where they are to be used - in ths case FindMyPast, and possibly offered in the various publications of D C Thomson.
I occasionally received emails from companies I have purchased from previously offering a discount if I use a particular code, the same codes also turn up on the various voucher codes sites.  Most of the on-line shopping sites that I have used have a 'do you have a promotional code? enter it here' box.  Usually I don't, but if I tried to make one up I am sure it would be rejected immediately.  I'm pretty sure that the online voucher sites are in the same position - only offering what companies themselves have put out.   As always though, I stand to be corrected if it can be proved otherwise

I didn't say the code didn't originate from them, I said there was no advert that say it was £10 for a year, the code was advertised as a sub for a £1.

There is a big difference to that so please do not misquote me.

Grouse I don't disagree about the free weekend, but that wasn't an annual sub discount.  Its the same difference as the fact they've had numerous £1 for 1 month subs this year.

What I said was that they have never had a discount of 90% on an annual sub, only on the month sub.  That is the difference and most likely what they are relying on.

Reluctantly, I think you are right, Smudwhisk, the only adverts for the year for £10 offer came from voucher sites and through word of mouth on various forums, not from FindMyPast itself. Where the mistake was made, was in FindMyPast's software allowing the code to be applied to a year's subscription rather than just a month's. This would probably be judged in law to be a genuine mistake and not an attempt to mislead people and I expect that FindMyPast took legal advice before refunding money and cancelling subscriptions.

I have not seen the original advert so cannot disagree with you.  I would be very interested is seeing it though if you care to post it.

I'm unsure so won't state it categorically, but my math seems to be on similar lines to that of grouse.
Offering 1 month for £1.00 to those without a sub works out at £12.00 per year (presuming of course that a yearsworth can be obtained), so it is not unreasonable for subscribers to think that a preferential discount of £2.00 applies to them, is it?  Especially as grouse implies, it would be a rather nice Christmas gift.

If we the public are to accept this as an error can you confirm that those who unchecked the renewal box previously only to have it auto-checked on taking up this latest offer will be refunded because although you have cancelled the subscription you haven't cancelled the auto-renewal.
In other words do you accept this as an error also & therefore doesn't have to be honoured.

Reply
Every new subscription automatically switches on the auto-renewal option and our customers have control to change that any time via their My Account page.

I note that you have cancelled your own auto-renewal option just a few moments ago.

As detailed in our terms and conditions, all customers who ask for a refund within 14 days of making a payment are entitled to a refund under our 14 day cooling off period (as long as the subscription has not been used).

So that's a no then.

I actually deliberately avoided mentioning the issue of the £1 per month multiples that the site appears to let people take out, because the issue has been with the annual sub discount.  Unfortunately, as I mentioned, this is still a discount on the monthly sub and not the annual, but I agree it does seem a little unfair that the site has let people use the monthly discount multiple times during one month, rather than them using the code once every month such a discount appears.  I suspect FindMyPast would still argue that the £1 per month offer is more limited, unlike a 90% discount on the annual, even though that also could be used more than once, and make sure they close the multiple use loophole as soon as they can.

As I have said, the number of people who probably have used the monthly discount code is probably lower because those of us with annual subs aren't eligible.  And this will probably be what they would argue in relation to whether it was fair to expect such a large discount.

It also would be interesting to know if anyone who used the month offer more than once is retaining those subscriptions because as far as I can see, they definitely can't use the misprice rules to override this, as its not a mistake in pricing, and also there is nothing to say it can only be used once.

I think its safe to say their T&Cs will get revised in the not too distant future.

The resposibility is quite clearly with you.
To cancel the subscription without cancelling the aut-renewal appears like FindMyPast are taking advantage of the error they created.
Subscribers took up this offer in good faith & will now find themselves out of pocket & trying to get refunded.
FindMyPast have turned this fiasco into a one way street in it's favour.
Doing nothing isn't an option.

Okay I phoned CAB

CAB say they were in breach of contract  >:( not honouring the sale BUT the recourse to that is to either, reinstate the purchase OR refund.
I queried them refunding without me asking and they said they shouldn't have done that  >:( but its done now. He said it COULD be pursued but advised it would not be worth the effort which reluctantly I agree with  >:(

 ;D Nothing lost, heigh ho.

Parmesan, did you actually mention the apparent misprice rule that they appear to be relying on or simply the fact they appear to have revoked a valid contract?  As far as I can see, under the misprice rule they don't appear to have to offer you a refund, they can simply do it.  But I am happy to stand corrected if anyone knows the exact rules.

At the end of the day, the advice given is only as good as the facts provided by the individual.  I don't mean this derogatively to you, but I know the CAB confirmed to a colleague of mine a few years back that she was in a jobshare when only she was "at risk of redundancy" (not her colleague who she believed she shared the job with) based on information she provided, but in fact her job wasn't a job share, nothing in the contract to that effect, and she had egg on her face somewhat when she challenged the employer to this.  In this case, it was the info originally provided that led to her being advised wrongly and perhaps them not asking the correct questions or seeing the paperwork.

At the end of the day, we've only lost out a benefit of £90 discount, they would probably have been out of pocket to the tune of a lot of money.

I've been given some legal advice that it is a straightforward breach of contract and a suggestion that a test case of small claims might be the way forward.  However, advice was that such an action, if successful, might kill the company.   :-\

Perhaps as well it is the way that it has been dealt with that has caused ill feeling. I'm sure we are all sensible enough to realise that it was a genuine mistake, probably caused by one person at FindMyPast who programmed the code acceptance incorrectly. Maybe if the letter withdrawing the offer had been more apologetic and had offered everyone a free month's subscription, people would have more sympathy with them. Instead it does seem as if they are trying to twist it and blame people for taking up the offer.

Again, as I asked Parmesan, did you mention to whoever you asked the fact they appear to be using the misprice rules to revoke the subscriptions?

If not, it may possibly have meant you would have received different advice.  I don't know for definite, as I said I can't find anything showing the exact rules online, but it does have a bearing on what advice would be given, even if ultimately they may give the same advice.

I shall now remove my Law Graduates hat and crawl back under my stone, but it does need to be considered when asking for advice. :D

Any new subscription on FindMyPast always lead to the auto-renewal box being ticked, I doubt they knew you had removed it previously and to be honest I doubt they had the time to check, if indeed they could, anyway.

I agree its annoying, but perhaps your post will ensure others do double check themselves and make sure they click the update button too.

FindMyPast are saying on their FB page:

"I see that our Head of Customer Services has confirmed to you that Findmypast did not quote that an annual subscription could be purchased for £10. This information was incorrectly quoted on other websites which are not related to Findmypast. Our sincere apologies once again for the disappointment caused by this."

However, when the advertised code was submitted on FindMyPast's site  it changed the subscription price.

I can't find anything showing the exact rules online

The general principles of the common law of contract (a vast and complex subject as you will know) apply.  A contract may be vitiated by (among other things) mistake, and whether it is or not will depend on all the facts of the particular case.

As I said in this old thread (post 32) subscriptions to FindMyPast are not covered by sale of goods legislation: www.rootschat.com/forum/index.php?topic=682699.msg5271488#msg5271488.  The Consumer Rights Bill which seeks to plug relevant gaps in statutory protection for consumers of digital content is still making its way through the Parliamentary process, having received its 3rd reading in the House of Lords this week.

As a Rootschatter and FindMyPast subscriber I empathise with those who are disappointed and feel let down by what has happened and the handling of the issue after the event.  As a litigator I'd recommend very careful thought before anyone embarks on the costly, stressful and uncertain adventure of litigation over this.

Title: Re: FindMyPast subscription £10 for year
Post by: smudwhisk on Friday 12 December 14 12:39 GMT (UK)
Thanks avm228.  I agree there would be little comeback for anyone trying to litigate against the company, not least because the "damage" is low, namely the loss of a £90 discount.

I know that subscriptions aren't covered by the sale of goods Act, but they are covered by other legislation which does I believe include provisions for mispricing, but am happy to stand corrected. As your quote from my post was about, I just can't find the specifics online and its too long ago that I studied contract law to remember them. ;)

Edit - I've just emailed Nicky Doran suggesting that if they had actually been more specific in their emails about what legislation they were relying on to revoke the subscriptions, it would have been far more helpful.

that would certainly satisfy me.  The email I received was kind of 'we can and we have' obviously not those words but that was the tone.

Its their total ineptitude that gets me, in most of the things they publish, even down to errors in history. Does ANYONE check stuff before it goes out?

Problem is they still have the best records out there so I'm stuck with them if I want to continue my family history.  :D

Tonight I was just muddling around and typed the SANTA14 code into FindMyPast subs bit (not logged in) to see what happened and found it is offering half price sub for a year.  Didn't try to extend mine but wonder if anyone else has found this?

Hi Jool,

I know, you lose all faith!

Was just hesitating before telling a friend who does not subscribe but who would probably like to at half price.  Well expect he won't lose out, at worst will get a refund and cancellation!!!

FindMyPast has lost so much goodwill over this but it will soon be forgotten and only those of us who have exhausted most avenues will think about cancelling, however this will account for quite a loss of revenue for them.

Hi

The code that started this whole debacle was FHSANTA14, if you apply that voucher code now it reduces the monthly subscription by 90% to 1 pound and leaves the yearly subscription as 99.50 pounds, on the other hand if you enter the voucher code as SANTA14 (omitting the FH) it leaves the monthly subscription as 9.95 pounds but reduces the yearly subscription (as others have said) by 50% to 49.75 pounds. Certainly in the past there has been a 50% discount offer for yearly subscription, and maybe there still/now is such an offer for new or lapsed subscribers but I haven't seen any publicity about it and, as I currently have a subscription, would not have received an email about such an offer.

Hello RootsChatters,

I actually signed into Findmypast.co.uk, then typed in the Code: Santa14, and it is coming up as WORLD and BRITAIN both individually at 50% off for a year.

Then I also went into our Findmypast.com.au account, and did the same, and it is also coming up with 50% of a WORLD Membership for a year.

Perhaps someone may contact Findmypast, and ask them if this is a valid offer, or if is still in error.

Still reading and following this Thread with great interest.

Does the same for me.  I had been in touch with them to have a moan about the lack of offers for World subscribers when they were frequently running 1-month for £1 for the UK subs, and this is an extract from their reply:

"we cannot confirm if there will be any World subscription offers run on the site as we are only site support"

So the answer to whether its a genuine 50% discount or not seems to be that they don't know, or if they do they're not telling!

I emailed them too and included a screenshot of the 50% discount and this is their response:

"We do run various offers on the site and it appears that you have received a discount code which is currently valid on the site, as the discounted amount for the 12 months World subscription is shown as £64.75 when you apply this".

So now they appear to be saying that if a discount shows when you apply a code then it is valid......

Like to see them renege on that one Jomot  :D
Am I being a bit thick here.  If application of a code shows a discount then it is valid.  I'm sure that's what I did with the £10 for a year code.

Nope, you ain't being thick !
I realise this thread is now getting old hat but I'm confused in that they are willing to reduce the worldwide sub by 50% thereby loosing £64.75 but they were unwilling to let us have the UK annual for £10 loosing approx. £79.55. I realise that's a few quid more but seeing as they had a free weekend not long ago and we were not reimbursed for these days surely it would have saved a lot of fuss and bother if they'd just let it ride
Maybe they run with the theory that no publicity is bad publicity as it's sure got us all chatting !

I'm with you precisely on this one. It really doesn't make sense at all.  :-\

If they want to get us talking that's fine, however, I work on a Help Desk and I am often asked by people just starting which would be the better website Ancestry or FindMyPast to subscribe to....they are not helping their case with all this! >:(

oops!  I might have some sympathy with small businesses relying on an outside company to ensure pricing is correct.  I have zero sympathy for FindMyPast part of a multi million pounds business who make glaring errors on a daily basis. (and don't seem to learn from them).

I have a feeling the FindMyPast half price offer will be taken down tomorrow if they see lots of folk have bought.  Its not been advertised anywhere that I can see.  I think the Saturday girl/boy may have their facts wrong.  They are not far off launching the new search.  I could be wrong though, I sometimes am  ;) :D

I sincerely hope it isn't wrong as several of us did enquire before taking up the offer and were assured it was correct.

Modem, I have had an email from Alex at FindMyPast and my account is now active and I have also had my £10 refunded.

Maybe if you still have a problem let them know, however I get the impression that they have resolved the issue now.

libby9,thanks for your suggestion I will contact them in a day or two regarding an extension, maybe by then thing's will have quietened down a bit!

Really!!!

Not sure I agree!  FindMyPast have a history of reneging on offers made on  their web site.  I may be wrong, but would say to those who've taken up the offer be prepared to be told it was a mistake [just another one by FindMyPast]

The company is unprofessional, and has proved over the past months  to be totally incompetent, I have no faith at all in FindMyPast, sad really as this time last year I would have been extolling their brand.

I agree with you.  They are unprofessional.  Repeatedly making offers to draw people in then reneging on them is not going to do them any favours at all  >:(

Add to that how problematic trying to find anything on their site now is, I was willing to give it another go for £10.  There's also no way of updating card details.

I've been a member for well over a decade. I've always been a big supporter but if they can't/won't honour their offer, they've lost that support.  The information they have is available elsewhere, just not quite as conveniently.

Personally I've found it invaluable for its Merchant Seamen records, the only other place I know of to look at these is the National Archives.  :)

depends on the geographical location you are looking at or your specialist topic.

There's a full list of England & Wales records here

http://www.findmypast.co.uk/articles/world-records/full-list-of-united-kingdom-records

Some local archives work with FindMyPast to digitise their parish records, others go with Ancestry.

For London & Middlesex you have to check both sites.

As Dawn said it depends what you are looking for. FindMyPast had an offer of £1 for a month, why not try it and see if the records you need are there? Just remember to untick the automatically renew box.

It is always worth visiting your local library as they have both Ancesry and Find My Past, both of which may be used for free - as long as you are a library member.  :)

My local library as FindMyPast for public access but also Ancestry for staff use only. So I suppose you could say they have both, just that you can only use one of them.

Hi All

I've been following this thread with great interest as I intended to subscribe to FindMyPast.

On 16 December, I bit the bullet, entered the promo code Santa14 and subscribed to World membership for half price.  I got an email receipt saying everything had gone through and I had World membership until December 2015.

Fingers crossed I haven't spoken too soon, but everything seems to be fine.

Kind regards
Caroline

I'm locking this topic now as it is well past the 20 page limit and has gently wandered off in a different direction.

The original offer on 14th December was withdrawn by FindMyPast and has been supseded by another.

I'm sure others will be along in the future.

If you wish to continue this topic, please start a new thread.
