Title: James Fowkes Burton on Trent Staffs

Hi Could somebody please help me, I am searching for the Death of my G/Grandfather who was born in Castle Donnington 25 September 1833. He married Ann Parsons 29 October 1855,he was in the 1871 Census in Burton on Trent there is a funny word which is hard to decipher under the Imbecile item, he then disappears and on my Grandfathers Birth Certificate it states he was dead. We have searched everywhere but unable to find him,without it we will not know if the child is his.Would appreciate any help you can give me.

Grandfathers date of Birth is 10 Jan 1874  Burton on Trent Staffs James George Fowkes

Are you aware of the rest of the Family on the 1881 Census RG11  2766  41  31

         It is transcribed that there Parents where a John & Ann Towns which is obviously a mistake.

Hi yes I am aware of John Towns Ann Parsons married him in 1880 7 years after James was born we had wondered if he had just disappeared !! A mystery

Hi again it is so much of a mystery as John Towns was not around in 1874 when my Grandfather was born where did he go,have wodered if the poor chap james Fowkes ended up in some mental Intitution. Have tried different spellings also.

It seems to be 'Shrop' (ie Shropshire) - it's in a different handwriting.

Hi Thanks for your answer we wondered if it was Shropshire too but if he was there in 1871 would he have been listed on 1871 Census? for Burton,have searched forever for his Death and as James George was born in 1874 he would have bee dead by then according to his Birth Certificate.

I think that this is just some sort of addendum to the 'place of birth' column: there is a Donnington in Shropshire, so it may have been assumed that that was where he was born, rather than Castle Donnington.

I wouldn't worry about it.... blasted officials....

Hi Thanks for question. James was born between 1833 & 1835 in castle Donnington in 1861 Census he was a maltser in castle Donington and in 1871 Census he was a Brewers Labourer in Burton on Trent. James George Fowkes born 10 january 1874 states father dead on Birth Certificate no death for James 1833 anywhere.

From the information given we are looking for a death record for James Fowkes b 1833 and died in 1873, I am wondering if he did die in that year. looking at the children, there seems to be a big age gap between Henry b 1866 and James b 1874 it may be worth widening your search from 1866 onwards

Thank you sooooooooo much will look it up, we had been wondering ourselves,but the 1871 Census states James was there,I wonder if this was John Towns as Ann could not read or write. She did not marry John Towns until 1880 but of course it could have been someone elses child.I believe 7 years was the time needed if someone disappeared?? and that could have been the case.

Section 57 of the Offences Against the Person Act 1861

Provided, that nothing in this section contained shall extend to any second marriage contracted elsewhere than in England and Ireland by any other than a subject of Her Majesty, or to any person marrying a second time whose husband or wife shall have been continually absent from such person for the space of seven years then last past, and shall not have been known by such person to be living within that time, or shall extend to any person who, at the time of such second marriage, shall have been divorced from the bond of the first marriage, or to any person whose former marriage shall have been declared void by the sentence of any court of competent jurisdiction.

a married womans husband is deemed to be the father of her child whether that be the case or not


have you looked under variants of Fowkes ?


to declare someone dead they have had to been 'missing' no contact with the outside world for a period of 7 years (UK law)
now i am not sure whether a death certificate would be issued if you wished to declare someone deceased for the actual death certificate acts as a licence for the undertaker to dispose of the body without this they cannot do so leagally but if there was no body to dispose of then would they need to issue a certifcate? these days the coroner dies issue a certifcate as it is also needed for monetary reasons insurances bank accounts etc. but back then did they have bank accounts or insurance ?

if Anne married John Towns in 1880 it does suggest that James was around in 1873 (7 years previous)

so you have James and Anne on the 1871 census what other documents are there that can help you located them from 1871-1874


have you looked at the actual PR's for Burton on Trent there does seem to be a big gap between Henry in 1866 & James in 1874 were there children born and died in between times?
was James working away ?
was one person ill ?
in prison ?

If HEnry went to school it would be helpful if you could locate his school records as this gives parents names and addresses as well as allowing you to gain an insight into school life and HEnrys childhood.

have you seen James 1874 christenening record there may be anote in the margin regarding his actual parentage  it depends on tehe Vicar though
